Beta Tester Terms and Conditions for Focus Play™

Thank you for your interest in beta testing the Focus Play™ app! Before participating in this beta program focused on gamification and habit building, please carefully read the following terms and conditions. By participating, you consent to these terms, which aim to enhance neurodivergent productivity and improve time management.

To participate in the beta testing of the Focus Play™ app, you must be at least 18 years of age. This beta testing is voluntary, and participation is not guaranteed, especially in the context of gamification and habit building aimed at enhancing neurodivergent productivity and time management. Please note that submitting an application does not guarantee selection for beta access.

The Focus Play™ app beta testing provides early access to unreleased features, allowing participants to give feedback on gamification elements designed for habit building. The purpose of this beta testing is to identify bugs, gather insights, and enhance the overall product experience, especially for neurodivergent productivity and effective time management, before the public release.

As a condition of participation in the Focus Play™ Beta Testing Program, you agree to the following Non-Disclosure terms:

You acknowledge that during beta testing of the Focus Play app, you may have access to confidential, proprietary, and unpublished information about its gamification features, designs, concepts, functionality, performance data, unreleased updates, and future development plans related to habit building and neurodivergent productivity ("Confidential Information").

You agree to keep all Confidential Information strictly confidential and not disclose, share, publish, or distribute any such information to any third party, including screenshots, videos, feature details, or discussions, without prior written consent from Focus Play™.

You may not copy, reproduce, or store Confidential Information for any purpose other than participating in the beta test and providing feedback to Focus Play™ regarding time management.

This obligation of confidentiality remains in effect both during and after your participation in the Beta Testing Program.

Any breach of this agreement may result in immediate removal from the beta program and may lead to legal action if necessary to protect Focus Play’s intellectual property.

You acknowledge that monetary damages may not be sufficient to remedy a breach of this agreement and that Focus Play™ is entitled to seek injunctive relief or other equitable remedies as necessary.

By participating in the beta test, you are entering into a binding Non-Disclosure Agreement with Focus Play™.

Any feedback, suggestions, or ideas you provide may be used by the Focus Play app to enhance the product's gamification, habit building, and overall effectiveness for neurodivergent productivity and time management. 

By submitting feedback, you grant Focus Play™ full rights to use this information without compensation or attribution. 

Please note that submitting feedback does not grant you any intellectual property rights to the Focus Play app or its features.

You acknowledge that the Focus Play app, in its beta version, may contain bugs, glitches, incomplete features, or unexpected behavior related to gamification. You accept that data loss may occur while utilizing this app for habit building and enhancing neurodivergent productivity, and that you use the beta version at your own risk in the context of time management.

Focus Play™ is not a substitute for professional medical, mental health, or psychological treatment. The Focus Play app is designed for gamification and habit building, but it does not provide any diagnosis, treatment, or medical advice. For concerns regarding neurodivergent productivity or time management, always consult a licensed healthcare professional.

Your personal information will be handled in accordance with the Focus Play app Privacy Policy. We do not sell or share your personal data with third parties. Data collected during beta testing may include usage data, app interactions, and feedback, all aimed at enhancing the app's features for gamification and habit building, particularly to support neurodivergent productivity and effective time management.

Focus Play™ reserves the right to revoke beta access to the Focus Play app at any time for any reason. If you wish to opt-out of the beta program, which focuses on gamification for habit building and neurodivergent productivity, you may withdraw at any time by notifying us via email.

Focus Play™ and its team are not liable for any damages, losses, or data issues that may occur as a result of beta participation in the Focus Play app, which utilizes gamification for habit building and enhances neurodivergent productivity and time management.

These Terms & Conditions may be updated at any time. Continued participation in the Focus Play app, which emphasizes gamification for habit building and supports neurodivergent productivity, constitutes acceptance of any updated terms related to effective time management.
